She has had the car registered in her name since then with no problem. DAUGHTER WAS SOLD CAR WITH LIEN STILL ON TlTLE, WHO IS LEGALLY RESPONSIBLE? My daughter was home on leave this past spring and bought a used car from a private indivudual. He signed over the title, and she went to the DMV to register it. She then returned to Virginia with the car, and I was going to forward the title to her when it came in the mail in her name. She had been back to VA about a month when she found a stick shift car (same make, but less expensive), and the dealer traded cars, and just gave trust that she would give him the title when it came in the mail. We never got it, because there is a lien still on it.. The individual she bought the car from is going bankrupt, so now she cannot get the title at all. She did nothing wrong on her part. Is the dealer responsible to deal with the lien holder, or "previous" owner? Wouldn't the DMV have been able to tell if it was a clear title or not? Who's to blame here, and what could be the outcome of this whole situation? She is only 19, and 1st time doing anything financially on her own.

How to best sell a car with a lien? I'd like to sell my car which is a 2009 Impreza. I have a lien through JP Chase. I have some negative equity, but I'm not that worried about that part. I can pay that off at anytime. Now my question is would I be better of trying to trade the car in to a dealership, or should I try to sell it private party? When I called chase they said I could pay off the negative equity, have someone pay the balance, and then they would send the title to the person. This really doesn't really seem feasible... Sold car with old lien? ok so i sold my moms car to the buyer. i had him look at the car and even showed him the title. he looked over both and asked price. we settled for 1100 and completed the sell next day. again i set the title in frontt of both of us and signed bill of sell. clearly stating "AS-IS"..after giving me the money we parted ways. my question is that the title had a lien from 2001 that has been paid off. but when he looked at the title he never questioned me about it, or said a word about it. me being stupid did not ask if he was ok with it and just assumed so. my mom lost the lien release papers and just ever bothered to get a new title. so my my question is if he call me and demands a refund, or takes me to court would i have to comply or is it his problem now? not trying to rip him off or scam him i just want to what i should do. if its my fault i will help him get it cleared but i justdon'tt want to get screwed either tho ok what if i got the paper saying it was released from the lien and then gave it to him, then can he go get a new title w/out lien in his name?

I called the Credit Union and they told me that I would just have to draw up an at home contract at home and wait for the title, sign it and give it to them. Really? This is a local Credit Union Partner in Dallas where we can go to pay of car but thats it, they dont do paperwork or anything, so buyer would still have to wait for title to come to me. Can a towing company sell my car in a lien sale if I have already paid them and received my car? My car was towed for 30 days because my fiance was driving without a license. We paid almost $2,000 to get my car out of impound, and now the dmv sent me a letter saying that if I return the bottom filled out within 10 days the towing yard will not have a right to sell my car unless they get permission from court. It also said total amount due: $600. So I don't know if they're trying to make it seem like we did not pay, or really what is going on. What should I do? Also, we paid the impound yard with cash, but we did get a receipt. Could this be why they're doing this?

I went to the place where they were selling the car (A towing/car resale place) and I looked at the car, seemed like a good deal and I bought it. Later, I found out that I had to pay $800 on the registration and I also found out that the car was a 2004, not 2006. I would of course have to deal with that charge, but the thing is, I did not sign the lien, the person who sold me the car filled it out, even though it says specifically for "Buyer to read and complete"... so the stuff filled out on the car lien was not my writing, but the sellers. I did sign the one other document that placed the car in my possession, but not the lien. They said I could not return the car, but I argued with them, threatening to take them to court. They called me back a few days later and said they would accept the car back. But when I got there, I racked up 200 miles on the car and they deducted $100 from the amount I paid because of that. What I'm wondering is, if they listed the car as 06 wrongly, and they illegally signed the document lien instead of me, and charged me $100 for 200 miles, would I have a case against them? Have you sold your car with an Ally lien on it? I am wanting to sell my used car privately and am confused about the process of lien releasing through Ally (formerly GMAC). Has anyone done this before and how did you have the buyer pay and how did Ally release the lien? I'm trying to figure out if I have to mail the buyer's (as soon as I have one) check in or if they can pay it off online or what. Can a car dealership sell a car when the original lien holder has not released the title? I bought a used car back in Dec and have not received my permanent license plate or registration yet. I called the DMV and was told that the dealership had not sent in the paperwork for anything other than the temp registration. I was told to call the dealership and get a new temp registration while they filled out the paperwork and if they did not to then go to the DMV and buy a temp and file a complaint against the dealership. I got the run around from the dealership yesterday saying they're not allowed to issue another temp registration and that I was fine with the expired temp registration.. that they had went to the DMV and they were told this. When I asked for proof someone else came out and told me that the original lien holder on the car had not released the title and that is what is holding the process up. They told me to come back in a week and they would give me another temp registration. I bought the car in AZ. Can a dealership sell a car with no title in hand? For Likable: I was issued a temp registration and temp paper license plate when I drove off the lot on Dec 27, 2007. Both of those expired Feb 12, 2008 which prompted me to call the DMV and ask them where my plates and registration were. I have financed this car and paid my first payment at the end of January. I live in Arizona (Maricopa County) After I bought it, it had some mechanical problems the guy did not mention, so I did not drive it for about 3 weeks, then I got a 15 day permit online so I could drive it, and at the end of the 15 days I took the title in to get it registered, and they said I could not since it had a restitution lien for $202 on it from Maricopa County Arizona. (Where I Live). I called the guy, and he said he just found out about it, and would pay it when he got paid. He emailed me on the 21st saying he paid it. I never heard back from him, so I called the MVD and said it still had the unpaid lien. I called the maricopa county office and they said he knew about the lien since JANUARY! I have been trying to get in contact with this guy since then, and nothing, he wont return my calls or emails. Should I take him to small claims court, or get a lawyer and sue him? HELP!

I sold a car with a lien on it. Is this illegal? When I bought my car in 2008, I put $30k down and the rest was financed as a "commercial loan" because the bank/dealership said that was the only way to get it approved. I didn't know what that meant, nor did I care, I just wanted the car. The bank then sent me the title the following month, with no lien showing on it. A year later I put the car up for sale, first calling the DMV and loan company and confirming no lien. I then sold the car (for $70k). The new owner went to register the car a few weeks later and to our suprise, the bank had just added a lien 3 days prior to her going to register it. (after a year of no lien showing) The problem is, I've already used much of her (the buyer's) money to pay down other higher interest loans. The bank says it just did some auditing and realized their mistake of having no lien. So now the buyer has a car she can't register, she's out $75k, and I don't have the money to pay off the loan. And I obviously don't have the money to buy the car back from her. I had planned to just keep making monthly payments until the "commercial loan" was paid off. What to do now?

I paid for the car in full (cash) when I bought it, and have a receipt. Is the person I sold it to going to have a problem registering the car? Whats the process of a car lien sale? So say that you dont have any interest in your car anymore after It was towed for 30 days but your still paying the finance company, what happens after you sign the lien transfer sheet over to the towing company? How does it hurt your credit and is the car sold at the auction way under value? If so, what is the process for paying the unpaid balance and if paid, will it still hurt my credit? If a person has a lien on a car, can they legally sell it to someone else on monthly payments? A man sold me a car last year....i made monthly payments of $300 dollars a month. i found out 6 months later he has a lien on it from GMAC.....was he legally allowed to sell it to me in the first place? The man that sold it to me still owes GMAC for it.The transfer case was broken the day i got it...it was broken way before i even bought it. I tried to get him to fix it for 6 months....after the 6th month I made him take the car back because it was broken and he tried to charge me $5000 to fix it. Now he is suing me trying to make me pay for the broken transfer case. I have a print out from the BMV stating the car has a lien on it and i also have records proving he had it into a car dealership way before i purchased it having it looked at for the same exact problem.

I bought this brand new Mazda from a shady dealership who failed to pay off my trade-in vehicle, and submitted a Retail Installment contract to the alledged lienholder yet they never registered and submitted the registration or title, also they were selling cars "out of trust" from their own bank; So 22+ other people got screwed also and the dealership has no money so no one can sue them for damages. These guys owe about 300,000 of unpaid liens from trade-in vehicles including mine. Now I got an attorney but the bank who at the moment holds no lien on the title since the title doesn't really exist in the DMV or the State is harassing me to make payments as my lawyer is trying to resend the deal and break the contract because the dealer breached it by not paying off my old car which in Florida if a dealer fails to pay a trade-in lien on a car after 30 days it is consider illegal. They even sold my old car without having the title from the lienholder which they failed to pay to.
how would i go about selling a car that still has a lien on it to an idividual wanting to buy it? its only a few more thousands nothing major... im wanting to sell for whats left on the car... but then this crap company that has the car tells me its gonna take 7 business days for a title unless i come in and do everything. ...im trying to help myself as well as the other party cause the company wants to refinance if im selling to somone else.... If car company charges off debt is the lien also released? I bought a car (in Illinois) recently found out when I tried to make payment arrangements that they wrote-off (charged off) the remaing $2,500 owed on the car. From the DMV site I have found out that I need: 1.Bill of Sale 2.Notice/Release of Liability 3."sold as is" contract 4.SMOG Docs. What I don't understand is if we(buyer and seller) must go to the DMV to do this or can this all be done via mail/internet. Also, how does the Title get handled after I get it back from my banK(I'm assuming I mail this after all the above is taken care of). Do I need to pay any transfer fees?(any estimation?) The DMV site doesn't really outline exactly how this needs to occur, only that I need the above. In Texas should I buy a car from a mechanic after he filed a lien? Ok, heres the deal. I'm in Texas and I'm thinking of buying this car from a mechanic. He had a woman bring the car in for transmission service but she left it and never paid. He says he filed a lien and "obtained ownsership". He said to get the car in my name we just need to go down to the registration office and file and pay the fee (whatever it may be). He also said to get the title all i need to do is have it registered to me and mail in for one, and i would get a clear title. I know ZERO when it comes to this thing. So heres what I want to know. If there is not a Expressed Mechanics lien on a car I bought from a friend can I leagally take it then? Ok my friend that is selling me the car....has the car in a shop. But Im thinking that sence the owner of the shop is more like a family friend to my friend he probabbly did not put the expressed mechanics lien on it.
