Should the major car insurance companies have an illegal immigrant clause ?
Everytime they crash into someones car,they always get away with it and their victim usually end up footing the bill. I've seen them get away with accidents more than once. Belleza,you're funny.

- Yet another un-informed person. What about people who are in the US LEGALLY BUT DO NOT HAVE INSURANCE!! A legal person crashes into someone, then the victims insurance must pick up the tab. An illegal person crashes into someone, then the victims insurance must pick up the tab. Spot the difference? It is simply the way insurance works: I'm not sure what sort of clause you mean, as whatever happens the only person who can pay is the victims insurance, or the perpetrator, if you can somehow get them to cough up.

- I say anyone involed in an accident their fault or not..... if they are UNINSURED ....they should not be entitled to sue or recover damages of any kind
- I must agree with Alex_F there are just as many, if not more, US Citizens or legal permanent residents that do not have insurance. In fact, I would be willing to bet money that there is a larger percentage that do not even own cars than there are that do and have no insurance. Uniformed public leads to a diluted belief that the illegal immigrant is the cause of all the U.S. problems and if we got rid of them "well that would solve everything, right"? No absolutely not. Insurance should be available to all who own cars regardless of legal status, in fact it is. Seguridad sin Barreras is all I need to say.
- They already do, its called Uninsured/Under-insured motorist coverage. If you are hit by someone who doesn't have insurance, or they do not carry high enough limits to cover your damages....this coverage kicks in. In my state it comes with a $250 deduct. And thats how it is across the us, if you have a vehicle it must be insured (well some states may not require that but the vast majority do). This is a non-issue my friend. Its been a non-issue for awhile now.

- I just don't know what that clause would be. I was talking to my insurance company and they said it would be a nightmare to allow illegals to drive. As it is now many citizens are driving without insurance. All you have to do is get it, get your paper and then cancell it. Yes....they report it to the state but some states follow-up immediately and others never do. Here you don't actually have to have it.....but you have to have some sort of paper signed with proof you have equity in something to financially cover any accident you might be in. You could be illegal and have countless identies and the legal struggle of finding the right person would be a nightmare, not to mention fleeing to Mexico to get out of any additional responsibility. When anyone else doesn't have insurance and you do.....your insurance foots the bill whether you are responsible or not. I know I had someone back into me in a parking lot and bash in the back of my car and leave. I know it was a construction vehicle of some sort because the painted end of the boards had hunks of wood imbedded in the car. Ya....my insurance would cover it.....after I pay my 500. deductable. Then since I would file a claim, my insurance would go up. I don't know if it would be better to have it as drive at your own risk and expense if all people aren't 100% required to have insurance....because I'm paying huge insurance fees for basically nothing. Meanwhile....I haven't had my vehicle repaired. I can't afford to fix it all on my own but I also can't afford the additional rise in rates to do it at the other end. Does no good to try and personally sue someone when they have multiple identies and no record of real income of property. All they have to do is say I don't have any money and don't own anything and the balls back in your court again with you footing the bill. Once again, abiding by the law appears to have no protection what-so-ever for the true victims. I know many states have the "no-fault" insurance. Meaning in less severe accidents they don't bother discovering fault in the accident or charging anyone with it. We constantly had minor incidents when it was race time or bike week and such and the Police would just wave you on and you had to deal with it yourself. I mean a report would be filed to show it happened but you were left having to hire a lawyer and personally sue someone for expenses beyond what your no-fault would cover. It's tough enough in a state, let alone other states and impossible with fake identies and illegal people who can, run, lie and hide.

- While your concerns are heard, as everyone has pointed out the situation is basically covered in our system of veh. insurance. The thing not mentioned, is that our insurance RATES are high as a kite due to the inordinate numbers of people who are driving, doing damage and having no insurance. Hmmmmm, wonder who these people who are? I recently had about $1000 worth of prop damage done by what turned out to be an illegal. He hit and ran of course. But through some slick, dick detective work I found him. When the police confronted him, he lied and then finally admitted his wrong doing. With me insisting, they impounded his unregistered car, he was unlicensed and uninsured. With pressure on him going to jail, I got him to pay about $300. When I called my insurance rep, she told me not to file a claim as it was likely my rates would go up even higher. In the last 3 years my ins. rates (property) have gone up 20-30% yearly each year. I have never had any claims. Course this increase is likely due to Katrina disaster but still the agent assured me, the Ins. folks are getting creamed on illegal caused, uninsured motorist accidents. (Then there are the deaths. We've all heard more people die at the hands of Illgal immigrants daily in the US ...than in the Iraq war.) Compliments mostly of lllegal visitors who simply don't care about the rest of us. And we foolishly allow this to continue at our own peril.
- I know exactly what you mean . I had an accident maybe 5 or six years ago by illegal only the driver was legal I will admit it is my fault I changed lanes and did not see them. My side view mirror scraped the side of their work van. They had a long scratch and my mirror came off. They did not even get a dent. They tried saying they were hurt needed therapy, car was totaled and the whole nine. I think my insurance settled with them not for a total loss but still it was such a scam. I do know that they hit people or slam on their brakes and get hit with like 20 people in the car. I have a friend that is a claims adjuster for a major company and say that illegals/legal immigrants especially (Russians in our area) run scams on insurance. They get a dent and need physical therapy, psychiatrist for PTSD (post traumatic stress). I don't know what can be done but it is crazy.
- Yes!! The illegal always gets away with it. It has happened here in Missouri many times. Drunk illegal driving, hits another car, injures or kills them, does an overnight in jail and is released so that they can appear at their court date. The illegal never goes to court and is never heard from again. There has been at least three of these incidents this year alone, all within the St. Louis area. It is intolerable!! And whats worse, we all pay for the illegal to drive through our uninsured motorist clauses, URGH!!!

- I wish, my wife's car was in an accident and the person who destroyed her car from behind was an illegar alien who didn't have insurance so we had to pay a lot of money for a new car. Thanks for nothing, and we are lucky she didn't have to go to the hospital.
