Can i get a free car if dealership didnt get paid by finance company?
i bought a car from dealer, financed. this car salesman is a little shady. i got approved over the phone from the finance co. so i signed bill of sale and he transferred the car to me. 3 days later he calls me frantic saying that the bank didnt pay him for the car because paperwork was incorrect. i am doing what my contract said. i owe the finance co. for my car. i shouldnt of said the paper work wasnt right. it was right. only thing is, this jerk car salesman ripped me off. and finance co. wanted him to get 6 references and some pay stubs ect. i was approved by the finance co. just this dumb car salesman let me drive off the lot without getting everything he needed. this guy is so dumb because he lied to the finance co. and said i put $2000 down on the car when i didnt give him a penny. contracts show a down payment that i didnt make. so when this all clears i either get $2000 or a car. all works for me. i would give him the things he needs but he tried to take advantage of me also there is no clause in the contract that states that if finance doesnt go through that dealership cancels the contract. while you guys are pretty much talking what you think you know. you need to know the law. go to. http://www.lemonlaw.com/spotdelivery.html

- somebody always wants something for nothing and obviously your that someone. why don't you take responsibility for what you did. you made the deal why don't you own up to it.
- The deal will not be funded, and you won't get title to the car. If they have to, they can sue you, or report the car stolen. The contract required references. And, you are required to provide them, just because he forgot to get them from you, doesn't get you a car for free. And you are calling him Shady?
- If the deal isn't funded, the contracts are void. It won't be actually in writing because it's common sense to most people(except you I guess). So basically it's not your car reguardless of what the salesman said or did. You won't get a penny back and if you don't return the car, you'll go to jail when they report it stolen. Truth is your the SCAM trying to get something for nothing..
- hard to tell what will happen, however, if I were you, I would just return the car and cancel the deal or give the references or something. As much as I hate dealerships and their sales people, I would hate even more for you to get into trouble by them. It aint a trillion dollars, don't get into possible trouble for a stupid car.
- It sounds like you're the one who's trying to rip the dealer off. What they did really sucks, but the bottom line is the car isn't yours. Never take delivery of a car without firm financing in place.
