My car is totaled, the other party is at fault, if i sell it to the junk yard, would i still get paid for it?
I have a police report. the other part is definitely at fault. my car is totaled and was towed to a Junk lot, where it is incurring storage charges every day. since the case has not been settled yet, and i only have liability insurance, the other party's insurance haven't paid me for my loss yet. My insurance suggested that I sell my wrecked car to the junk yard for a couple of hundred bucks, this way it stops incurring storage charges, but i am worried that this is going to interfere with the other party's insurance not paying me the full amount of the vehicle's value. Anyone knows anything about this? Who should pay for the storage charges? Thank you very much in advance its a 2000 toyota celica in excellent condition, market value around $6000

- If the other party is at fault, the other person's insurance policy will have to cover those costs; including storage, towing, etc. You should not be responsible for any of those charges, even if you only have liability. Now if YOU are deemed at-fault, then you will be responsible for those charges. But if you're absolutely certain it's the other guy's fault, I wouldn't worry about it.

- I cant say this enough, GET A LAWYER, if the other party is at fault, there insurance is responsible, but if you don't have legal representation on your end, insurance companies know that you are at they're mercy, don't be a victim, they can let your car sit, and incur-re charges, then give you just enough money to cover the bill, how will you get another car?, I am not saying everyone is like this, just giving you another side to the story, because this happened to me when I was a young man, and if I can keep it from happening to someone else I will. hope this helps
- Do not sell your car to the junkyard!!! you will get nothing from the other insurance company. when your car is totalled the insurance, in essence, will buy the car from you. they will give you a check for your car based on fair market value in return for your title. if you sell you car to he junk yard, assuming you sign the title over to them. they will own the car. you will get nothing. the other insurance company will pick up the storage charges once liability resolved. Have they sent you a storage mitigation letter? if not, your good to go. don't bother getting an attorney, there is no money it it for them unless your injured.

As long as you have not received a "stop storage letter", or if the claims rep has not advised you to move the vehicle to someplace where it is not incurring storage, you are all set. As long as they accept 100% liability, they will pay you the ACV for your vehicle, storage, tow fees etc. Go to nadaguides.com and use the low value. That is roughly how much you will receive for your vehicle. You do not need an attorney unless you want to throw money away. Most attorneys do not take Property Damage only claims anyway. If you have further questions, call and speak to the claims rep handling your claim.
- if your car was totaled and the other insurance is going to pay you for your loss, the the vehicle belongs to them, if you sell it to a junk yard then that will be less to you claim
