If there is not a Expressed Mechanics lien on a car I bought from a friend can I leagally take it then?

Ok my friend that is selling me the car....has the car in a shop. But Im thinking that sence the owner of the shop is more like a family friend to my friend he probabbly did not put the expressed mechanics lien on it. Also doesn;t the shop have only so much time to do it otherwise they can lose out on the money if my friend sells the car?? Like say it was 5 months ago that the shop owner fixed the car and is just storing it for my friend till he comes up with the money would you think he put an expressed mechanics lien on it? I dont! So would I be able to take it legally then???? let me know asap! explain well to please thanks

  1. The time frame has nothing to do with it. It can sit there for 2 years! It doesn't matter! Your only hope is to talk to the shop owner and see if he will release the vehicle and give you a receipt that the repairs are paid in full (even if they have not been paid for) or negotiate a payment plan and amount. If you do not stick to the payment plan he can still put a lien on it at anytime. Good luck!
