buy car out of state can they sing the car title without notary witness?

If i buy a car out of my state can they sign the car title without notary witness and bring the title home, go to a notary and get the paper work done with out him there??

  2. Legally no... the purpose ofthe notary is that the person is who they say they are when they sign a legal document. You may need to send the titlke back to them and ask if they can have someone notarize the title for them when they produce the proper identification. Many notaries often will go ahead and notarize it if they trust you or personally know you, but that's risky for them. If the signature is a forgery and someone notarizes the document, they could be in a lot of legal trouble. Check with your state - some states do not require a title if the car is old enough, then a notarized bill of sale works. Contact the seller, and havethe title sent back to them via tracable means (certified mail), and ask him to take care of it... he shouldn't have signed it if was required to be notarized. But if its a rural area and his local banker has known him for 20 years, likely they will just see it as an honest mistake and notarize it for him. Good luck -
  3. If a signature needs to be signed before a notary, that means that the notary must be in front of you when you sign the document. So, your plan of signing without the notary, then getting a notary won't work, then whole idea behind the notary is that the notary is verifying the identity of the person signing the document. They will have a seal or stamp that is applied, as well. All states don't require the signature on the title be notarized.
