Is it against law for dealer to sell car with bad catalytic converter?

6 months ago I got this 2000 Jeep Cherokee, just noticed that the Cat Converter was not only rusted through, but TAPED back together whith what looks like some sort of mechanics tape. Was it legal for the Dealer to sell this car? Obviously if its rusted through it could not have happened in the last 6 months since the inspection. What are my options.

1. Absolutely they can sell an 8 year old vehicle like that. Did it ever occur to you the owner prior to the dealer did that repair to the converter? You are 100 percent liable for all costs, no if ands or buts. I can weld one in for you for 250.00
2. not really illegal but it does not matter, has a 8yr 80k warranty on emissions, but if they wont fix it I can weld in a new one for 200.00
3. should have brought it to your mechanic and have him or her check it over for you before you bought it.
