If a person has a lien on a car, can they legally sell it to someone else on monthly payments?

A man sold me a car last year....i made monthly payments of $300 dollars a month. i found out 6 months later he has a lien on it from GMAC.....was he legally allowed to sell it to me in the first place? The man that sold it to me still owes GMAC for it.The transfer case was broken the day i got it...it was broken way before i even bought it. I tried to get him to fix it for 6 months....after the 6th month I made him take the car back because it was broken and he tried to charge me $5000 to fix it. Now he is suing me trying to make me pay for the broken transfer case. I have a print out from the BMV stating the car has a lien on it and i also have records proving he had it into a car dealership way before i purchased it having it looked at for the same exact problem.

  2. You mean that GMAC has a lien on it? Who were you paying? If he paid down his debt with GMAC, then fine. Otherwise, he will be in trouble for selling it. You could be as well to the extent that GMAC takes the car away from you.
  3. No. If someone has a lien on the car they cannot sell it to you - and the DMV should not have switched the title without proof of a lien paid off. I'd say you better check into things.
  4. no he illegally took money from u knowing that he owed money on that car.u can take him to small claims court and get your money back.
