My friend wants to take her car from the title loan repo lot, How can I convince her she will get in trouble?
My friend just got enough to pay the title loan today, unfortunately while she was at the bank getting the money, the title loan repossessed her (other) car. Since she can't get it straightened out until tomorrow, or possibly monday (if title loan company does not recognize saturday for business) she wants to have her husband go to the title loan place and take the car and hide it at someone's farm in their barn. I told her that would be really foolish, she could get in LOTS of trouble! Please give me the heads-up on what can happen to her and her husband for trying this, I don't want her to make a bad choice! Thanks. Thanks everyone! I learned a lot!

- I recommend that your friend hire an attorney who has experience going after lenders. Many lenders have committed fraud in the process of making the loan. I recommend that she ask the attorney look for irregularities in the lending process that she went through to get the loan in the first place. then go after the lender in court and file complaints against the lender with the appropriate regulatory agencies. she should not try to take the car from the lot. she does not want to be in the position of complaining about illegal behavior of the lender when she may have committed some improper behavior herself. Just go after the lender in court and with the various regulatory agencies including the local District Attorney's Office and the Federal Trade Commission. the lender will likely cave in. the lenders in most cases have been very sloppy and are often in violation of the regulations that they are supposed to be following. You can nail the lender in court if you find that the lender has violated any regulations, which they probably have.
- Her and her husband need to get a grip and do it the right way. Basically the car belongs to the lender right now, and until it is paid off. So, If they take it, first off they will be trespassing to do it and second it will be basically a car theft. Yes theft. Have them take care of it the right way then all will be good. If they wont be able to afford it once they get it back they wil need to just let it go. No saving their credit now. & years that will be better. Or like the previous answer have an attorney check the documents for any misleading practices. But, call the attorney, get it straight, DONT LET THEM TAKE THE CAR, they will turn a credit problem into a criminal problem!
- car repos are civil not criminal that is unless you come face to face with the repo men and you refuse to let them take it, or if they do get it and you take it back. That is when it becomes criminal. GTA
- The car was legally repo'd. She and her husband can be prosecuted with vehicle theft. Legally - it's not their car anymore. If they want to get with the company and pay them...they may be able to redeem the car. But stealing it back will be a felony.
