Illinois car exhaust law? - previous question, another question...?

Answer from a previous question about IL car exhaust laws: "625 ILCS 5/12-602. No such muffler or exhaust system shall be equipped with a cutout, bypass or similar device. No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise of such vehicle above that emitted by the muffler originally installed on the vehicle, and such original muffler shall comply with all the requirements of this Section. --- Hope this helps. Attorney John M. Kogut (Illinois)." Question is what if YOU did not make the modification, but purchase a vehicle that has had this done, are YOU responsible... "No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise of such vehicle" -- If YOU are not the PERSON that modded, can you get a ticket??

  1. This would require the current owner of the vehicle being grandfather'd in a way for each muffler. I would think that it is pretty clear that regardless of who modified the muffler, the muffler would be in violation. If this was not the case, the law would be useless. In every instance of a modified muffler, the current owner would simply be able to say the previous owner did it and absolve themself of all responsibility. I hope my viewpoint helps.
