Car insurance lapsed and got in a car wreck? HELP!?

My boyfriend, Adam, and his friend, Chad, were driving home on Wednesday night. Chad was driving home in Adam's car. They had been drinking and hit a telephone pole. Chad got a DUI and has Progressive car insurance. Adam's insurance lapsed...meaning there is no insurance on the car. In this case, who do you think is at fault here? Also, what do the insurance companies typically do to help? or not help? I just need to get advice.

  1. Did Chad have permissive use to drive Adam's vehicle, obviously so. You have no recourse in this situation. You have no insurance, so it's Chad's issue to pay for any property damage (which Progressive may cover due to him being at fault...but I doubt they will step up to the plate because of the DUI). It's up to Adam to handle any towing, storage and repairs to his car.
  2. they will not do anything to help they have no insurance they will have to pay for the pole if it broke and the car will have to be fixed by your own cash or junk it lucky they didnt kill or hit another vehicle because they would have to pay for all the repairs out of there pockets or whome ever was driving and to boot now has a dui on there drivers license good luck trying to get insurance know being a high risk

  4. Chad is legally liable for any of the damage he caused. Since he was driving an uninsured vehicle, his insurance is considered primary excess coverage. His liability insurance should pay for the property damage. It will not pay for the damage to your boyfriend's vehicle. Chad's own collision may cover the damage, but it is unlikely. He needs to report the loss to his insurance company. The adjuster will review the policy and determine if coverage applies. Unless he has a specific exclusion on his policy which denies coverage for DUI, he is covered. Stupidity is covered unless it was intentional.
