How can I sell a car that has a lien on it and I don't have the title?

The car is broke down and it costs more to fix it than it is worth. I would like to sell it for cheap but I don't have the title. I understand I have to still pay the loan company that has the title but is there a way to sell the car without a title? BTW... I live in FL and the loan company is in NC.

  1. You have to pay off the loan company first, get it released from the lien, get the title, sell the car.... Whoever buys the car cannot get the title until the lien is released....
  2. To sell a car in Florida, it has to have a Florida Title. You have to settle the lien first. Then you can get a Florida title in your name. That is called a clear title. Then you can sell it. You cannot sell a vehicle when it is not yours. If there is a lien holder, they own the car, not you. I don't know the situation. I know a guy with a Trooper he owes $7300 on it. He has dent and beat every inch of it. He blew up the engine. Someone stole the doors and the windshield is busted out. I wouldn't give him fifty bucks for it without the paperwork. It has been in his yard for a year. Finance company is still looking for him.
  3. here is how, go to the buyer, tell them what the situation is-they may be planning to finance, in which case, the new finance company will do the work to pay off the old company, however if the buyer wishes to pay cash, go to an escrow company, use their services, establish an account, have the buyer pay them, they will settle the account with the finance company, and forward the signed title to the new owner. Then they will forward the balance to you if you are selling it for more than you owe on the car, minus their fees. QED (quite easily done)
