I'm trying to make a little sense out of this situation....?

We had an Airstream for sale, in the paper. We sell cars and trailers all the time. Lots of times the people who act interested disappear and never come back. Some people called about it, asked if we'd take less for it. The answer was, if you get here with the money before it is sold, it's yours. On the day they were supposed to come buy it, they were four hours late. There were two other buyers, and one of them offered $500.00 more for it. So we thought we'd be courteous and call the first people, since they live out of town, and tell them that if they really want it, they need to pay the asking price, 'because we have a buyer, but y'all called first, so I wanted to offer it to you'. They said OK, they'll pay what we're asking. They came, paid the money, got the trailer, and we have a signed Bill of Sale. Then the woman came back and said she was suing us. Well, they were INFORMED and they didn't have to buy it, right? So she actually DID sue us and WE LOST! Isn't it your right to sell or not to sell. We could have asked $1,000,000.00 for it because it's ours to sell for whatever we want, right??? They paid first and threatened later! There was no reasoning behind the judge's decision. When my husband started to shake his head in denial of points they lied about, the (female) judge started to scream and threatened him with contempt, and never let him defend himself. I feel that a judge who flies off the handle, is in no mental state to be a mediator of any kind. It was shockingly unprofessional and my husband really did nothing disrespectful. Plus, we had the Bill of Sale. TEXAS justice! I mean...We are so befuddled that this question had to go on HERE! The beyotch judge wouldn't explain it or give us a chance and she ordered trhe Bailiff to escort us out. We never spoke out of turn or were nasty in any way and THEY were. No we aren't planning to appeal it. Lawsuits aren't our bag. It's only about $500.00. It's more the point of the thing, and we'd like to know...OH, and the judge DID say that we should have sold it to the person with the cash, and not called the first people, because that showed that we "felt like we had a contract" enough to call them.And that screwed us right there. I don't believe this. It's Bullsh*t. We thought we were doing the right thing. How would it have been if we HAD just sold it and let them come all that way to find it gone??? They'd have sued us for that!

  2. I'm trying to understand this - what were the grounds for the lawsuit and what was the judge's ruling (not that you lost, but why did you lose)?

  6. I would consult an attorney about this (I'm taking it you didn't have one with you when you were in court). It sounds like you might have a case to appeal the verdict.
  7. I don't understand the reasoning behind the court's ruling, nor the lawsuit itself, and the judge does sound a bit unprofessional. So many people in our society will sue you over anything. To me, they are all acting like spoiled children who didn't get their way. Almost no one is willing to take responsibility for their own actions, and would rather blame someone else and extort money from them in return. I would probably appeal this if possible but I am not a lawyer and don't know alot about legal issues. Good luck with whatever you decide to do.

  9. This transaction does not sound much different than buying and selling Real Estate. I think that you did the right thing and the Judge was a jerk. You have been screwed, sorry. There are too many lawsuit happy people in the world today. Lesson learned.
  10. Let it go! Your long-winded narrative of the events has the answer in it . You say the judge wouldn't explain her decision but at the end of your long retoric you say she did tell you you screwed yourself when you called the first person back. There's your answer. You messed up trying to be nice. Next time you'll know better but this time let it go. If the first people did try to sue you after you sold the thing to someone else they wouldn't have had a leg to stand on. Now you know.

  12. That's madness, but it is a culture that seems to be common in America now, suing people for everything and anything. I live in Ireland and a local radio station was discussing this point one day and they researched the web to find out the ridiculous reasons that people have gotten money for nothing. One of them was a woman in America sued a furniture store because a child running loose in the store ran into her and she fell over and broke her leg. Funny thing was, it was her child, yet the store was still made to pay her a few hundred thousand dollars for letting children run around the shop. It seems that in America you can sue for anything and you will win, no matter what. It's a pity that money means more these days then what common courtesy. You did do the right thing, but unfortunately, they took advantage of your kindness.
