They said they would throw it in for free and now they want me to pay for it ??? where do i stand ?

Hi there, i ordered a Brand new Mercedes about 3 weeks ago. The car had to be ordered from the factory because of the extras and they had found a similar car to what i wanted already built but i had an extra 6 cd changer and Dab radio built in which i had not ordered on my car. Therefore the sales woman rang me and said they had found me a car but it had two extras which were a cd changer and DAB radio, she said they cost 500 but they will give them to me for free. Now the car has been delivered to the dealers and all the finance paper work has been signed and the 20,000 cash has been paid the sales person now says i still owe them 550 pounds before i can collect the car for the cd changer which i was told that it was going to be thrown in for free. They say i either pay it and have the car that is delivered or they have to order me a new one from factory and the prices have risen this week for the same vehicle and i would be subject to new prices if i decided to buy the one i ordered previously. What do i do now ? where do i stand ??? i never signed nothing to state that i had ordered a cd changer i have sorted all my insurance and everything on the car which i was supposed to collect on sunday. Could you please advice on where do i stand in this situation ? I really want the car on the 1st but i why should i pay the 550£ which they told me i dont have to. what could i say to mercedes dealerhip ?? thakns

  1. If it's not in writing, it never was said or happened. Pay up for your extras!
  2. Get a hold of the sales person who called you to tell you it was being included. Since you don't have anything in writing you have no basis for your arguement. Your options are to pay it or take your business elsewhere.
  3. lucky you to be able to pay 20,000 grand cash for a new car, another 500.00 will not bust your bank, so pay up and shut up
  4. contact mercedes directly and tell them how the dealership is treating you they will not stand for shaby practices especially in the way the world economy is presently
  5. Stick firm on this. Even Merc dealers behave like Back Street Swiss Tony's from time to time. Call their bluff or walk away. They see you as a cash cow and sense your desperation, but that salesman works on commision, and he really, REALLY wants your sale. Play them like they are trying to play you.

It sounds as though the salesperson has sized you up as a mug.Tell them,in no uncertain terms,that they will be sued for misrepresentation,amongst other things,You must get a solicitor on this,they are also breaking a legally binding verbal agreement.The price was agreed at the time of sale,this is also legally binding.They sound a very dodgy outfit,you may want to notify the local papers of this situation also,it is at best,very sharp practice.
  7. Benz dealers are pretty upfront and honest. Just speak to the salesman, see what he/she has to say. If you don't get anywhere, just pay the 500, it's a small price to pay for a cd changer from the factory.
  8. Check with trading standards. I think if you have signed a contract for a 20thou vehicle of agreed specs and they provide one diffrent i would imagine you can reuse to pay the exctra unwanted parts, either ask them to remove them or state you want the car you ordered at the price as agreed in the contract. If you verbally agreed to accept the car with extras for free, and they offer verbally for free - if they say they never said that, then you can say well i didnt verbally agree to accept a car that wasnt as per my contract. Your contract would say what you asked for- what specs.
  9. Have you a signed and dated order without the cd auto changer listed & the Original amount of money agreed? Firstly contact the Sales Manager or Dealer Principal and give them opportunity to investigate. They might not be aware that the salesperson has misled you. If you have no joy there contact Mercedes head office directly and advise the practise the dealer is carrying out.
