Used Car Sales Warranty direct from dealer?
My mum bought the new car 2 months ago. from the mitsubshi dealer. she bought it 2 years old with low mileage. She came up with few plms. i kept telling her to take it back to have it put right. as she had warranty for a year i think as the car came with 4 year warranty when bought new i think. She finally took it back and they said she need new brake pads and new brake discs as they are low. my mum only driven the car less than 200 miles in 2 months. that is a short trip to the local shop and to supermarket for daily shopping. due to her pain in legs etc she cant go anywhere much. The dealer said she have to pay for the brake pads and discs. The question is. shouldnt the dealer have had the car checked and ensured it would last longer than 200 miles before the customer comes back to have it sorted? The brakes seem to be low and never inspected. the problem she had was the brakes was shaking when used to slow down, Someone help with the law or something. i am not that good about it. Thanks in advance. Paul it been from when she bought the car. she delayed it for 2 months. There must be something about used cars that have to be tested safe and drivable. the brakes was hard to brake since she drove home.

- Unless you have in writing the dealer will cover wear items like brake pads, you have no legal recourse here. Brakes wear out and most warranties do not cover wear items like brakes, wiper blades, tires, engine oil, etc. Warranties only cover mfr defects or major failures like a transmission. I would take the car to another repair shop for a second opinion. If it comes back that the brakes are worn out and need replacement, she will have to pay out of her pocket for repairs.
- Laws do not apply here. It is not illegal so sell a car with slightly worn brakes. Warranties also do not apply because brakes are meant to wear out so they are never covered by any warranty.
- Used cars are always sold AS-IS, unless you get a warranty in writing. If the car is only 2 years old, it may still be under the original factory warranty as long as the mileage has not exceeded the limit. But brakes are almost NEVER covered. Plus, it's always up to the buyer to have the used car inspected not the dealer. All they usually do is make sure it's roadworthy and it obviously was since the brake issue didn't come up for 2 months. You can't blame the dealer two months later since they can't predict the future.
