I live in CA and want to sell my car but it needs a smog and currently has a non op is it legal to sell?

I want to sell my car but it needs a smog and currently has a non op is it legal to sell? I love the car but would be too expensive for us to fix and would rather see it gone. just want to know if it would be legal for us to sell since it has some transmission problem we do have a non op like I mentioned already...thanks for your answers appreciate it in advance.

  1. If your car has a current non-operational status with the DMV, you are exempt from smogging it before you sell it. Only road worthy cars have to be smogged before sale. The new owner will have to make the repairs and smog it before he/she can re-register it for the road once again.
