My car was repossessed by the title loan company, can it be sold after only 17 days?

I got a auto title loan in Wichita KS. I was late on my loan and after a month of no payment, they repossessed my vehicle on 05/18/11, I called them today 06/03/11 to get the amount so that I could make payment when I got off work and they informed me that I could no longer pay on the balance to get my car back and after ten days it is their vehicle. The lady on the phone informed me that I should have received a certified letter stating that. The problem is I never received a certified letter. Is this legit and can I take legal action against this company? I don't understand how your answer pertains to my question, Tim W.

  1. Yes you have to pay for things you buy.
  2. They have to give you at least the difference between the value of the car and the amount you owe them. I'd suggest that you look for some free or inexpensive legal assistance. Kansas Legal Services has an office in Wichita. They should be able to help you. Their number is 316-265-9681.
