Can I still sell my old car to the government without taking smog test?

When I took my old car (1994) to a test only smog check center for a failed smog test in order to sell it to the government, the smog technician told me that because of its problematic transmission, he couldn't put it on the test. But I heard that you can still sell your car to the government without taking smog test. Is that true? For your information, the car's engine still works very well, but it runs slowly.
